The meeting was chaired by Julie Walsh, along with experts Heather Warton and Larissa Ozog. They were joined by community representative Carl Peterson.
Ms Walsh is a solicitor with more than 35 years of experience in local government planning and the environment law and is currently the chair or alternative chair on three local planning panels in the Sydney metropolitan area.
Ms Warton is a town planner with more than 30 years of experience and is on two local planning panels.
Ms Ozog is also a town planner with more than 20 years of experience in local government. Ms Ozog has worked with Randwick and Waverley Councils and the Department of Planning. She also currently sits on the Wollongong planning panel and Cumberland planning panel.
Mr Peterson is a civil engineer with more than 40 years of experience in major projects. He is on the Southern Region Planning Panel.
The panel listened to submissions regarding the subdivision of 27 Kimberley Drive, Bowral, also known as Milton Park.
Mr Peter Rowe addressed the panel against the subdivision.
Mr Rowe said the application in the council's report was "deficient, misleading, contained errors and provided no reasonable justification for its approval."
"This application is only about the developer further subdividing and fragmenting land at Milton Park," he said.
"The report does not adequately address the heritage impacts and does not consider the future sale of village two."
Mr Rowe said the reports deficiencies included incorrect statements that the subdivision is consistent with the approved village two and provides lands for village two in the same way as village one and dismisses the objections made.
Mr Scott Lee addressed the panel on behalf of his client in favour of the subdivision.
Mr Lee said he was familiar with the development application and that the council's report addressed all concerns.
"The report also deals with the issues raised by the Milton Park objectors," he said.
"The issues raised are without substance largely because they have no material relationship to the application you are considering.
"The application involves a totally compliant two lot subdivision."
Mr Lee said the application related to the original approval in 1985 for tourism use.
"It's the final piece of the puzzle," he said.
The subdivision of 27 Kimberley Drive was refused by the interim advisory planning panel for several reasons.
The panel found that one of the proposed lots did not comply with the minimum lot size of 40 acres, that the panel was not satisfied that the subdivision was necessary for the ongoing operation of permissible use and that it was appropriate having regard to the natural and physical constraints of the land.
The panel also found that the proposal did not represent orderly and economic development and failed to consider the impact of the development on the heritage significance of the heritage item.
Other decisions made by the interim advisory planning panel included:
- A modification to the development application for proposed alternations and additions to the Wingecarribee Shire Council Administration Building be approved and that no further works were to be carried out until the Building Information Certificate has been issued.
- A planning proposal to be prepared to amend part of the Wingecarribee Local Environment Plan to rezone from R2 low density residential to B5 business development at Planning Proposal to rezone land at Welby Garden Centre.
- The panel also refused a planning proposal to rezone and reduce the minimum lot size of land at Alpine.
- The planning panel also chose to not support a planning proposal to rezone 63-69 Kirkham Road, Bowral from IN2 light industrial to B4 mixed-use.
- Planning Proposal to undertake administrative amendments to Wingecarribee Local Environmental Plan 2010 under Section 3.22 of the Environmental Planning & Assessment Act 1979.
- The panel supported a planning proposal to undertake administrative amendments to Wingecarribee Local Environmental Plan 2010 under Section 3.22 of the Environmental Planning & Assessment Act 1979 and to replace the current reclassification maps with maps labelled in accordance with the Department Planning, Industry and Environment's current LEP technical specifications and to apply a minimum lot size of 700m2 to land at 9-19 Anembo Street, Moss Vale.
