In a meeting on October 24 councillors voted to refuse a development application for 51-53 Kirkham Street in Moss Vale due to a landscaping policy departure.

The Moss Vale design control plan required a total landscaped area of 50 per cent. The Kirkham Street DA provided 43 per cent.
This was not the first time the proposal had been before the council.
On September 11 councillors voted to liaise with the applicant and requested a redesign.
Council staff said the applicant did not wish to redesign the application and as a result it was recommended for refusal.
The nine dwelling housing proposal involved the demolition of the existing structures on the property and the construction of nine single storey villas.
Kirkham Street resident Patricia Ban addressed council and expressed concerns about the development's impact on her privacy.
She said it would result in an alfresco area looking into the rear of her house.
"The proposed units are too close to their neighbours," Miss Ban said.
Councillor Ian Scandrett moved to approve the application with provisions to plant hedging along the north west boundary. The motion failed due to lack of a seconder.
Councillor Grahame Andrews moved to refuse the application.
"As soon as you allow one the whole philosophy of some consistency is gone," he said.
The council "should stick with its DCP consistently."
Cr Scandrett argued against this.
"I'm arguing that we should show a little bit of flexibility on this one," he said.
The motion was passed five to one with Cr Scandrett recording his dissenting vote.
