Wingecarribee Shire Mayor Duncan Gair has today confirmed that the Gibraltar Park complex has been issued with the necessary approvals allowing residents to move in to the newly constructed seniors living complex.

A Section 68 Approval for temporary sewerage work was issued under the Local Government Act 1993 and a Building Information Certificate under the Environmental Planning and Assessment Act 1979 on Thursday, December 13 for the development.
Key to approval being granted was acceptance from WaterNSW allowing the developer to provide temporary sewerage pump-out services for the residents.
This temporary arrangement cannot exceed three months at which time the developer must complete the necessary permanent infrastructure for wastewater disposal.
To facilitate this infrastructure construction, temporary closures of Old Bowral Road will be required in the coming weeks.
“This arrangement is far from ideal however I applaud the staff of Council working with the developer in coming to a solution that allows the residents to move in prior to Christmas,” Mayor Gair said.
Consent for wastewater disposal is the latest compliance issue that has been brought to the attention of council since work began on the Old Bowral Road development.
As part of the recent approvals being granted, Council has sought guarantees from the developer that they continue to liaise with them to ensure a repeat of similar circumstances is avoided.
“Despite a Private Certifier being appointed by the developer for the site, as the local regulatory body council cannot allow occupation of a development to proceed until all buildings are considered safe and essential infrastructure is completed and approved,” the mayor said.
“To do so is not only unlawful but could compromise the local environment and place the safety of the residents at risk.
“We appreciate that residents were keen to move into their new units as soon as possible.
“But we must reiterate that prior to any occupation being allowed the building must first comply with the National Building Code of Australia.”
“I am however confident that now this latest issue has been addressed the developer will continue to work with Council to ensure a smooth transition for all residents and future owners.”
