A risk factor in domestic violence Crime is the presence and access to firearms. Across Regional NSW, firearms ownership is prevalent, and a significant responsibility of firearms owners is to prevent illegal use and guard against theft.
Police officers attending domestic violence incidents must, under NSW Legislation, ask if there is firearms in the home, no matter what type of incident they respond to from arguments to serious criminal offences.
Under NSW legislation, NSW Police Force officers must seize firearms at the house of a domestic violence incident, under Section 85 of the Law Enforcement Powers and Responsibilities Act 2022 (NSW).
Regardless of who owns the firearms, the firearms will be seized when Police attend a Domestic Violence incident in a home.
- A Firearms licence will be suspended if police later form a view that:
- A domestic violence offence may be committed or
- If a licence holder is later charged with a domestic violence offence and/or
- If the licence holder is listed as a defendant on an interim Apprehended Domestic Violence Order (AVO) licence will be automatically suspended
Police may also seek to suspend a firearms license if they believe that the owner cannot exercise continuous and responsible control over the firearms.
The firearms will be transported to a police station and stored there. Police will:
- Photograph the firearms to document the description and condition of them and
- Notify the Firearms Registry of the seizure.
If the Firearms licence Holder is not subject to any action or is the victim in a Domestic Violence matter, the licence holder may apply to have their firearms returned within 28 days, in writing to the Commander of the Police District.
