In a council meeting on July 25 councillors Ian Scandrett, Ken Halstead and Larry Whipper moved to rescind the approval for a housing development for over 55s.
After debate and a split vote by councillors mayor Duncan Gair used his casting vote to reject the rescission.
The development at two Orchid Street was first approved on July 10.
At that time Wingecarribee Shire Councillors debated for more than hour about whether the two story development that will consist of four three-bedroom apartments should be built.
Cr Ian Scandrett said Colo Vale was essentially a rural village and not a main town.
"There is so much interest in this matter," he said.
"The [residents of Colo Vale] like thier leafy outlooks and Australian bush."
Cr Scandrett said the development looked like a block of flats.
Colo Vale resident Karl Batshon said in an address to council that the zoning which allowed the development was innapropriate and unlawful.
"If I place a Ferrari label on my Mazda it does not become a Ferrari," he said.
Mayor Duncan Gair said "if the state government had not changed the legislation to allow seniors living in Colo Vale it would be an illegal development, but it's not an illegal development."
"People have the right to live where they want."
