A development application (DA) for the construction of 11 multi-dwelling housing units was approved subject to conditions of consent at the April 10 council meeting.
The approved development, which includes earthworks and associated landscaping, is earmarked for 5 Cliff Street and 11 Clarke Street, Bowral
There are more than 100 conditions of consent, including compliance with the Building Code of Australia and insurance requirements under the Home Building Act, compliance with the Disability Discrimination Act, and water and sewer authority controls.
Prior to approval, neighbours were notified about the DA, which was advertised for a period of 45 days between January 3, 2018 and February 16, 2018.
The proposal attracted nine objections, which included privacy impacts, building height, overshadowing, excavation and building setbacks.
A previous DA was lodged for this site seeking approval for 16 multi-dwelling housing units.
This was lodged December 19, 2014 and was refused by council in early 2016.
This application was refused for several reasons including amenity of adjoining neighbours, the difference in density of surrounding neighbours current and future and the style of the development.
The scheme was reduced and challenged in the Land and Environment Court, with the court dismissing the appeal on several grounds.
In the latest neighbour notification period, five submissions received also indicted that there were "inconsistencies throughout the documentation submitted to council detailing what was proposed".
"Council's review of the application showed some minor inconsistencies with some terminology within the reports," the council responded.
"However, this inconsistency does not change the overall proposal put to council.
"One of the reasons mentioned in the Land and Environment decision to dismiss the appeal for the refusal of the previous application was that the scheme did not contain any consistent documents in which to grant an approval to.
"These submissions have used this reasoning to cast doubt on this iteration of the application."
An amendment that the matter be deferred to address concerns raised by residents in submissions was put to a vote and lost.
